Order On order of the Court, the application for leave to appeal is considered, and it is DENIED, because we are not persuaded that the question presented should be reviewed by this Court prior to the further proceedings ordered by the Court of Appeals and any subsequent review by the Court of Appeals. The application for leave to appeal as cross-appellant is also considered, and it is DENIED. The motion of the Michigan Municipal Risk Management Authority for leave to file an amicus curiae brief is considered, and it is GRANTED. The Prosecuting Attorneys Association of Michigan's motion for leave to file an amicus curiae brief, which was not accompanied by a brief, is DENIED as moot.
